Balancing Care, Compassion, and Professional Advocacy

Information source: www.PFAC-Pro.org/

Embodying the essence of care, compassion, and professional advocacy, a Professional Fiduciary is more than just a guardian of assets; it’s a dedicated calling. In the state of California, where fiduciaries operate, licensing from the Professional Fiduciaries Bureau under the California Department of Consumer Affairs is mandatory. Our professionals bring diverse backgrounds as former attorneys, CPAs, bankers, social workers, or healthcare providers. Many have joined after personally addressing the intricate needs of a family member or loved one, making their responsibility unique, essential, and noble.

A Symphony of Roles: Fiduciary Services May Include:

  • Trustee
  • Guardian
  • Estate Executor
  • Daily Bill Paying and Money Management
  • Healthcare Representation
  • Agent under a Power of Attorney
  • Executor for seniors with no spouse or family
  • Conservator for the mentally or physically incapacitated

And many other roles tailored to individual needs.

The Role of a Fiduciary as Trustee: The Trustee’s responsibility is to execute the terms of the trust as outlined in a testamentary or living trust document. A fiduciary ensures a seamless transition in cases of incapacity or death, stepping in when a named successor is absent.

The Compassionate Conservator: A Conservatorship is a legal tool to manage the financial and/or personal affairs of individuals deemed incapacitated. A fiduciary, appointed by the court, navigates the complexities with prudence, safeguarding the conservatee’s assets and ensuring the individual’s well-being.

Guiding as Personal Representative: Appointed by the probate court, a fiduciary acts as a Personal Representative—Executor or Administrator—to administer the estate of a decedent. This involves intricate tasks, including asset management, income collection, and asset distribution.

The Protector as Representative Payee: Designated by authorities like the Social Security Administration, a fiduciary manages the income and expenses of an incapacitated individual, ensuring their financial well-being.

Holistic Advocacy as Agent Under Power of Attorney: In health and financial matters, a fiduciary acts as an Agent under Power of Attorney, making crucial decisions with utmost care. This includes healthcare determinations and financial management aligned with the client’s written instructions.

Our Commitment: At EEA Fiduciary Services, we believe in nurturing a bond of trust, concern, and attentive caregiving. Our fiduciaries seek to support mental and emotional well-being, alleviate stress, and, above all, help each client and their families enjoy a fulfilling life.
